Trump, Election Theft, and the US Constitution

So, with the revelation of MASSIVE & WIDESPREAD FRAUD & DECEPTION in working closely with Big Tech Companies, the DNC, & the Democrat Party, do you throw the Presidential Election Results of 2020 OUT and declare the RIGHTFUL WINNER, or do you have a NEW ELECTION? A Massive Fraud of this type and magnitude allows for the termination of all rules, regulations, and articles, even those found in the Constitution. Our great “Founders” did not want, and would not condone, False & Fraudulent Elections!

That was Trump's posted comment about the Constitution which set off the latest clacking among the media and the institutional political class this week.

Contrary to the claims from all quarters, he did not call for the termination of the Constitution. In fact, he didn't call for anything.

He made a statement, in the context of his claim that the election was stolen and that the proof came out two years later, which, in that context, raises a valid question: where is the remedy? Does the law offer a remedy or does it allow a criminally installed government to continue to govern? That's not a call for anything - he is laying out the choices presented by the reality of the situation.

Now, I don't follow the logic of "stolen" elections generally, because they are ALL stolen - in fact, elections, by their nature, represent a theft of power of self-governing democracy by the alienation of this power to "representatives" who are selected by rules NOT chosen by the voters.

But the I take issue with those who claim that accusations that the 2020 election was stolen are patently false, fake news, sacrilegious, etc., or was somehow cleaner than 2016 or 2000 or 2004. The fact is that there were very real problems with 2020 that were unprecedented in their nature in form, that have in substance, however, been a problem for many years, with the largest among them being ballot-stuffing, albeit in a new way.

What is unique about 2020 is that there were changes in the procedural laws, rules and regulations which were extreme in scope and largely illegal in the framework of Constitutional law, and those changes clearly changed the outcome of the election in Biden's favor. None of this was even entertained by the courts in the various lawsuits filed before, during and after the election. Instead, the state and federal courts dismissed each of the challenges on every possible threshold matter available - standing, timeliness, etc., etc.

In one case, where there was no pro forma defect to toy around with, the Court simply said, in essence, "this might change the outcome of the election and we do not feel that it is the role of the Court to do so."

In that context, where Trump says - as believably as we did in 2000 and 2004 - that the election was stolen, and in the context of the evidence of malfeasance by Biden, FBI, DHS and the media, among others, he says, essentially, "OK, it was stolen and now everyone can see it - so what can be done?"

Because there is no remedy that anyone can offer in the framework of the law for what was, in essence, a coup.
